1 TERMS AND CONDITIONS

1.1 The promoter to this competition is Dotsure Limited (Registration Number 2006/000723/06), a licensed non-life insurer and authorised financial services provider (FSP39925) referred to as “dotsure.co.za”.

1.2 The affiliate to this competition is Pick n Pay Retailers (Pty) Ltd (“Pick n Pay”) (registration number: 1973/004739/07) a company incorporated in the Republic of South Africa and having its registered address at 101 Rosmead Avenue, Kenilworth, 7708.

1.3 All persons entering the dotsure.co.za and Pick n Pay Pet Club competition ("the promotional competition") ("the entrants") agree that the competition rules as set out in these terms and conditions are binding on them. A copy of these terms and conditions is available at www.pnp.co.za.

 

2 IMPORTANT NOTICE

2.1 These terms and conditions and competition rules contain certain terms and conditions which appear in similar text style to this clause and which:

2.1.1 may limit the risk or liability of the promoter or a third party; and/or

2.1.2 may create risk or liability for the entrant; and/or

2.1.3 may compel the entrant to indemnify the promoter or a third party; and/or

2.1.4 serves as an acknowledgement, by the entrant, of a fact.

2.1.5 the entrant cannot be a juristic entity and must be an individual;

2.2 The entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.

2.3 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the promoter in terms of the Consumer Protection Act, 68 of 2008 ("the CPA").

2.4 The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.

2.5 All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless dotsure.co.za and Pick n Pay Stores Limited and all entities in the Pick n Pay group; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.

 

3 RULES OF THE COMPETITION

3.1 This competition opens from 09:00 on Tuesday, 1 March 2022 to 23:59 on Saturday, 31 December 2022.

3.2 To enter the promotional competition, the entrant must:

3.2.1 Be a registered Pick n Pay Smart Shopper card holder and must have signed up for the Pick n Pay Pet Club prior to 31 December 2022.

3.2.2 Successfully complete an obligation free, dotsure.co.za pet insurance quote either on the dotsure.co.za website (https://www.dotsure.co.za/picknpaypetclub) or via the dotsure.co.za call centre by entering their details at (https://www.dotsure.co.za/picknpaypetclub). For the avoidance of doubt, please note that your entry will only be regarded as successful once you have reached the pop-up screen on the website which displays the message that entry has been successful, or a dotsure.co.za call centre agent has sent you a quote.

3.3 Pet Club members entering this competition are eligible to win the following prize: R5 000 (five thousand Rand) in Smart Shopper points, which amounts to 500 000 Smart Shopper points for each of the 10 (ten) qualifying winners drawn.

3.4 Winners may be asked to provide proof of such Pick n Pay Pet Club membership.

3.5 The 10 (ten) winners will have to provide their Smart Shopper number, whereafter the points will be loaded onto their card.

3.6 For the avoidance of doubt, entrants shall only be eligible to win once, hence, if your name is drawn as one of the monthly winners, you will not be eligible to win during the rest of the competition.

3.7 Prizes are not transferable and may not be exchanged for cash or other prizes.

3.8 The prize is not interchangeable and the allocation is at the full discretion of dotsure.co.za and is not negotiable.

3.9 All entrants must use their own correct personal details to enter.

3.10 Multiple entries per person will not be permitted.

3.11 Entry is free of charge.

3.12 There is no automatic prize for entering.

3.13 In order to qualify as an entrant for this promotional competition:

3.13.1 the entrant must live in the Republic of South Africa;

3.13.2 the entrant must provide correct and full personal details, as required; and

3.13.3 the entrant must be 18 years old or older.

3.13.4 the entrant cannot be a juristic entity and must be an individual;

3.13.5 The competition is open to all registered Pick n Pay Smart Shoppers that join the Pick n Pay Pet Club.

3.13.6 The promoters, Dotsure Limited, their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above-named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.

3.13.7 The affiliate, Pick n Pay Retailers (Proprietary) Limited, any entity in the Pick n Pay Group or Company, their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.

 

4 SELECTION OF WINNERS

4.1 There will be 10 (ten) winners in total, one per month.

4.2 Quotations done between 1 March 2022 and 23:59 on 31 March 2022 will form part of the March 2022 draw.

4.3 Quotations done between 1 April 2022 and 23:59 on 30 April 2022 will form part of the April 2022 draw.

4.4 Quotations done between 1 May 2022 and 23:59 on 31 May 2022 will form part of the May 2022 draw.

4.5 Quotations done between 1 June 2022 and 23:59 on 30 June 2022 will form part of the June 2022 draw.

4.6 Quotations done between 1 July 2022 and 23:59 on 31 July 2022 will form part of the July 2022 draw.

4.7 Quotations done between 1 August 2022 and 23:59 on 31 August 2022 will form part of the August 2022 draw.

4.8 Quotations done between 1 September 2022 and 23:59 on 30 September 2022 will form part of the September 2022 draw.

4.9 Quotations done between 1 October 2022 and 23:59 on 31 October 2022 will form part of the October 2022 draw.

4.10 Quotations done between 1 November 2022 and 23:59 on 30 November 2022 will form part of the November 2022 draw.

4.11 Quotations done between 1 December 2022 and 23:59 on 31 December 2022 will form part of the December 2022 draw.

4.12 The winner for March 2022 will be drawn on or before 07 April 2022.

4.13 The winner for April 2022 will be drawn on or before 09 May 2022.

4.14 The winner for May 2022 will be drawn on or before 07 June 2022.

4.15 The winner for June 2022 will be drawn on or before 07 July 2022.

4.16 The winner for July 2022 will be drawn on or before 08 August 2022.

4.17 The winner for August 2022 will be drawn on or before 07 September 2022.

4.18 The winner for September 2022 will be drawn on or before 07 October 2022.

4.19 The winner for October 2022 will be drawn on or before 07 November 2022.

4.20 The winner for November 2022 will be drawn on or before 08 December 2022.

4.21 The winner for December 2022 will be drawn on or before 12 January 2023.

4.22 Entrants to whom prizes will be awarded will be selected through a random draw.

4.23 An independent attorney will oversee and certify the conducting of the competition.

4.24 Winners will be contacted via email or telephonically by a dotsure.co.za representative. Winners that have no valid contact details will be excluded from the draw. If winners have not been able to be contacted within 3 (three) working days, they will forfeit, and a backup winner will be selected.

4.25 For the avoidance of doubt, please note that dotsure.co.za will share the winners’ details with Pick n Pay for the purposes of validating the winners Smart Shopper account and allocating the prize.

4.26 Pick n Pay reserves the right to disqualify a winner if he/she does not respond to the email or telephone call within 3 (three) working days of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. In the event that the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately.

4.27 dotsure.co.za reserves the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, its advertising agencies, advisors, suppliers and nominated agents.

 

5 GENERAL

5.1 By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the promoter to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.

5.2 Winners may be requested to take part in the promoter’s or affiliate’s publicity campaigns or to allow their names and likenesses to be used by the promoter or affiliate for promotional purposes. Winners are, however, entitled to decline such request.

5.3 The promoters shall conduct the competition, and the Promoters’ decision on any matter related to the competition, including the selection of prize winners is final.

5.4 Fraudulent and duplicate entries will not be allowed and dotsure.co.za reserves the right to disregard these entries.

5.5 We will respond to any questions or queries about the competition via email, Nadia.sheik@dotsure.co.za.

5.6 By accepting the terms and conditions, all participants hereby consent thereto that, should they be drawn as one of the winners, they allow dotsure.co.za and/or Pick n Pay to publish their first name on the dotsure.co.za and/or Pick n Pay social accounts and the monthly dotsure.co.za and or Pick n Pay Pet Club newsletter/ mailer. Should the winner however not want their first name published, they must inform dotsure.co.za and/or Pick n Pay immediately, failing which dotsure.co.za and/or Pick n Pay will proceed to publish their first name.

5.7 dotsure.co.za accepts no responsibility for any damage, loss, liabilities, injury, or disappointment incurred or suffered by you as a result of taking part in the competition. dotsure.co.za further disclaims liability for any injury or damage to you or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the competition.

5.8 dotsure.co.za shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation, or any other circumstances amounting to force majeure.

5.9 The competition will be governed by South African law and entrants submit to the exclusive jurisdiction of the South African courts.

5.10 These terms and conditions constitute the competition rules which are available for inspection on the dotsure.co.za and Pick n Pay websites.

5.11 ALL ENTRANTS WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS.
